MITIGATION SPECIALIST

The Mitigation Specialist is responsible for investigating and analyzing relevant mitigation evidence for both trials and post-conviction proceedings in capital cases and for preparing comprehensive social histories of capital defendants through client interviews, collateral interviews with multi-generational family members and others, and the collection and evaluation of life history records. This position is governed by state and federal laws and agency/institution policy.

Typical Functions:

Obtains release of information forms from client and from attorneys, if court orders are needed to obtain information. Obtains and organizes past client records regarding school, medical, psychiatric, and employment histories. Summarizes records and reports for attorneys. Interviews family and/or past associates in home or other setting regarding life history of client. Interviews client in jail regarding social/behavioral history. Makes recommendations to attorneys regarding pertinent historical information for mitigation and collaborates with attorneys to devise a plan or mitigation. Attends court hearings and trials and perform functions of a notary public. Assists Director in handling compliant letters from inmates regarding the Public Defender. Performs other duties as assigned. SPECIAL JOB REQUIREMENTS: Frequent in-state and out-of-state travel is required.

Knowledge, Abilities, and Skills:

Knowledge of legal research methods and procedures. Knowledge of record keeping systems. Knowledge of investigative techniques. needed information. Ability to identify sources and conduct interviews of potential witnesses to obtain required information. Ability to prepare and present oral and written reports. Ability to research, analyze, interpret, and apply legislation and case related information. Ability to coordinate various activities of legal section/office employees.

Minimum Qualifications:

The formal education equivalent of a bachelor’s degree in psychology, sociology, or a related field; plus two years of experience in criminal investigations or a related field. Additional requirements determined by the agency for recruiting purposes require review and approval by the Office of Personnel Management. OTHER JOB RELATED EDUCATION AND/OR EXPERIENCE MAY BE SUBSTITUTED FOR ALL OR PART OF THESE BASIC REQUIREMENTS, EXCEPT FOR CERTIFICATION OR LICENSURE REQUIREMENTS, UPON APPROVAL OF THE QUALIFICATIONS REVIEW COMMITTEE.
